How fees are decided

Professional fees depend on: technical complexity · number of claims · provisional or complete filing · search depth · complexity of examination responses.

Official fees are separate and depend on the applicant. Individuals, startups, small entities (including MSMEs) and educational institutions pay reduced official fees, about one-fifth of the standard fee.

Scope and limits

Drafting, filing and representation before the Patent Office are carried out by the registered patent agent. Vsolv Research provides technical, search and coordination support. The Patent Office decides whether a patent is granted.

Frequently asked questions

How much does it cost to file a patent in India?

There are two parts: official fees, which depend on the applicant category and filing stage, and professional fees for search and drafting. Individuals, startups, MSMEs and educational institutions pay reduced official fees. We give you a written quote covering both after reviewing your invention.

Can I publish my paper before filing a patent?

File first. Publishing, presenting or displaying an invention before filing can destroy its novelty, and Indian law allows only narrow exceptions. A provisional application can be filed quickly before a conference or journal submission.

What is a provisional patent application?

A filing that secures your priority date with a description of the invention. The complete specification with claims must follow within 12 months.

How long does it take to get a patent in India?

Under normal examination it often takes several years. Startups, small entities, women applicants and some other categories can request expedited examination, which is much faster.

Can a new formulation of an existing drug be patented?

Possibly, if it is new, inventive and industrially applicable. Section 3(d) of the Patents Act also requires enhanced efficacy for new forms of known substances. A patentability search and a review of your data show your chances early.

Who actually files my patent?

Our patent partner Bansari Antala, an independent Registered Patent Agent IN/PA-5922. Only registered patent agents, or applicants themselves, may file and act before the Patent Office.
