Publish first or file first? Patents for researchers

In short

File first. A patent is granted only for an invention that is new on the filing date, and your own paper, poster, thesis or conference talk can destroy that novelty. A provisional patent application can be filed quickly before you disclose, and gives you 12 months to file the complete specification.

Why disclosure matters

Novelty is judged against everything made public before your filing date, anywhere in the world. That includes your own journal article, preprint, poster, conference abstract, thesis placed in a library, product launch, or a talk to people who are not bound by confidentiality.

What Indian law allows

The Patents Act, 1970 has only narrow exceptions, such as certain displays at notified exhibitions and a paper read before a learned society, with a 12-month limit and conditions attached. Do not plan around them. Many other countries, including those in Europe, have no general grace period, so an early disclosure can block protection abroad even where India might allow it.

A safe sequence for researchers

  1. Record the invention. Keep dated lab records and a short invention disclosure.
  2. Search. A patentability search shows whether the idea is new before you spend more.
  3. File a provisional application describing the invention as fully as you can.
  4. Then publish or present. Your priority date is secured.
  5. File the complete specification with claims within 12 months of the provisional.

Practical tips

  • Use a non-disclosure agreement before discussing the invention with companies or collaborators.
  • Check your institution's IP policy; the institution may own or share the rights.
  • If your thesis contains the invention, ask about delaying its public release until you have filed.
  • For pharmaceutical formulations, gather data showing improved efficacy early, because new forms of known substances face section 3(d).
